Temporary Foreign Worker Program (TFWP)

Canada as a country attracts a lot of tourists and workers every year. One of the biggest reasons that immigration have is the development of various visiting visas and work visas to meet the demands.

And one of the work visas is the Temporary Foreign Worker Program (TFWP). The TFWP is designed to help employers to recruit international workers temporarily in Canada. Let’s know everything about the program in detail!

TFWP Eligibility Criteria & Requirements

To be eligible for the program, both the employer and the prospective foreign workers must meet the following requirements:

For Employers

Labor Market Impact Assessment (LMIA)

Employers must apply for an LMIA, which serves as a permit proving that hiring a foreign worker will not negatively impact the Canadian job market.

Job Offer

The employer must offer a genuine job position to the foreign worker, outlining the terms of employment, salary, and other relevant details.

Compliance with Wages and Working Conditions

Employers are required to offer salaries and working conditions that comply with Canadian labor laws and norms.

For Foreign Workers

Work Permit

Prospective foreign workers must obtain a valid work permit before coming to Canada. The work permit is generally issued for a specific job and employer.

Qualifications and Skills

Foreign workers must be qualified and have the necessary training, experience, and abilities.

Types of Work Permits Under TFWP

Employer-Specific Work Permit

This type of work permit is position-specific and issued in accordance with the name and location of the company. The only employers who may hire a foreign worker are those who are specified on their work permit.

Open Work Permit

With the exception of individuals who are either ineligible to hire foreign workers or who have high-security clearance requirements, foreign workers with open work permits are able to work for any business in Canada.

TFWP Work Permit Application Process

Here are the most followed steps you need to keep in mind while applying for a work permit:

  1. The employer must demonstrate efforts to hire Canadian citizens or permanent residents for employment in order to obtain an LMIA from Employment and Social Development Canada (ESDC).
  2. Following the LMIA’s approval, the business makes a formal job offer to the chosen foreign worker, including the conditions of employment.
  3. The foreign employee can apply for a work permit from Immigration, Refugees and Citizenship Canada (IRCC) with the approved LMIA and employment offer.
  4. Depending on the applicant’s country, they might need to submit biometrics and go through a medical exam.
  5. The processing time for work permits may vary depending on a number of variables.
