Canada Introduces New Free Trade Agreement with Ukraine

On July 5, 2024, Canada introduced new instructions for businesspersons under the Canada–Ukraine Free Trade Agreement (CUFTA). The provisions, effective from July 1, 2024, facilitate the temporary entry of businesspersons between the two countries, aiming to strengthen economic ties and promote investment opportunities.

The CUFTA provisions categorize eligible businesspersons into four main groups: business visitors, intracompany transferees, investors, and professionals. This classification allows for a streamlined process for individuals seeking temporary entry to Canada for business purposes, enhancing economic cooperation between Canada and Ukraine.

Work permit applications under CUFTA will be assessed according to paragraph 204(a) of the Immigration and Refugee Protection Regulations (IRPR), which is part of the International Mobility Program (IMP). This regulation permits the issuance of work permits without the need for a Labour Market Impact Assessment (LMIA), simplifying the application process for eligible businesspersons.

Categories Under CUFTA:

  1. Business Visitors: Individuals who are entering Canada for business meetings, conferences, or site visits, without directly entering the Canadian labor market.
  2. Intracompany Transferees: Employees of multinational companies who are transferred to Canadian branches, subsidiaries, or affiliates, facilitating seamless internal business operations.
  3. Investors: Individuals who have made or are in the process of making a significant investment in Canada, contributing to the economic growth and development of the country.
  4. Professionals: Qualified individuals who possess specialized knowledge or skills, and are entering Canada to provide services under a contract.
