The open work permit for vulnerable workers allows eligible foreign workers holding employer-specific permits to change employers without requiring a Labour Market Impact Assessment (LMIA). This policy ensures that workers can safely leave unsafe work environments while maintaining their legal work status in Canada.

Key Updates to Application Procedures

The latest changes introduce several operational improvements aimed at ensuring consistency in how applications are assessed. Immigration officers now have clearer instructions regarding evidentiary requirements, missing documentation handling, and the assessment of cases that may not meet the legal definition of abuse but still involve potential worker vulnerability.

Another important update confirms that applications for this permit cannot be submitted at ports of entry or at IRCC offices outside Canada, reinforcing the requirement that submissions be completed online unless exceptional circumstances apply. Documentation and Eligibility Considerations

Applicants must provide a letter explaining the abuse or risk of abuse, along with any available supporting documentation. Settlement agencies, enforcement bodies, and support organizations may assist applicants in gathering documentation and accessing guidance throughout the process.

The revised program delivery instructions also provide updated procedures related to immigration medical examinations, refusal decisions, and officer documentation requirements, improving transparency and consistency across processing centres.
